Conditions of participation
for the competition organised by SD Grenzgaenger International GmbH
1st organiser
The competition is organised by SD Grenzgaenger International GmbH, Gablonzerstr. 4, 76185 Karlsruhe (hereinafter referred to as the "Organiser").
2. eligibility to participate
Natural persons aged 18 and over are eligible to participate. If a participant has limited legal capacity, the consent of their legal representative is required for participation.
All persons involved in the conception and implementation of the competition and employees of the organiser and their relatives are not eligible to participate. The organiser reserves the right to exclude persons from participation at its own discretion if there are justified reasons, in particular in the case of
- Manipulation with regard to access to or realisation of the competition,
- violations of these conditions of participation or
- False or misleading information provided by participants in connection with participation in the competition.
3. competition period
The competition begins with the publication date on 2 December 2024 and ends at the end of 31 December 2024 (hereinafter referred to as the "competition period"). Participation in the competition is only possible during the competition period.
4. participation in the competition
Participation in the competition takes place by ordering goods via the website grenzgaenger-shop.com (hereinafter referred to as "Grenzgaenger-Shop").
A prerequisite for effective participation is that an effective purchase contract is concluded between the organiser and the participant via the Grenzgaenger shop during the competition period and that the purchase contract is not cancelled or revoked within the statutory periods. A value of goods totalling 80,00 euros must be reached in order to participate in the competition ("qualified order“). All orders from the X-Mas Drop from December 2nd to 3rd, 2024 (X-Mas Hoodie and Sweater) will also be considered as „qualified orders“
Multiple qualified orders placed via the Grenzgaenger shop during the competition period will increase your chances of winning in the prize draw. Each order corresponds to one ticket.
To order goods from the Grenzgaenger shop, you must provide the following personal data:
- First name and surname
- Address and e-mail address
The participant will be referred to these conditions of participation on the website. The organiser's general terms and conditions apply to the order of goods and the purchase contract itself, irrespective of these conditions of participation.
Orders for goods received after the end of the competition period will not be considered, regardless of the reason for any delay.
The organiser reserves the right to change the competition procedure at any time. Changes will be announced in good time in advance on the website and on the organiser's social media channels.
5. prize and draw
A 2024 Husqvarna FE 450 with Supermoto wheels from the brand Excel, custom decals, and a custom seat cover will be raffled off among all participants in the competition.
The draw will take place on 03.02.2025. The winner will be determined at random. The draw and the result of the draw will be published on the organiser's social media channels. The organiser will notify the winner by email to the email address provided when ordering the goods. The winner then has 21 days to contact the organiser and accept the prize. If the winner does not contact the organiser within this period or does not declare acceptance of the prize, the claim to the prize expires without substitution. In this case, the organiser is entitled to carry out a replacement draw and determine an alternative winner at random.
The prize will be presented to the winner in person at their place of residence, but only within the territory of the European Union. The personal handover to the winner will be filmed and/or photographed. The film and photo recordings will be published, in particular on the website and on the organiser's social media channels. By accepting the prize, the winner agrees to the filming and photography as well as the publication of these recordings. If the winner does not give their consent, the prize will be deemed not to have been accepted. The claim to the prize shall lapse without substitution. The organiser is entitled to carry out a replacement draw and determine an alternative winner at random.
6. premature termination of the competition
The organiser reserves the right to terminate the competition at any time without prior notice and without giving reasons. This applies in particular if proper implementation cannot be guaranteed for technical or legal reasons.
7. data protection
The personal data of the participants mentioned under point 4 will be processed exclusively for the purpose of the proper execution and handling of the competition. The data will not be processed for any other purpose. The processing of personal data is therefore necessary for the fulfilment of the contract and for the implementation of pre-contractual measures with the participants. The legal basis for data processing is therefore Art. 6 para. 1 sentence 1 lit. b GDPR. In the event of a win, the first name and place of residence of the winner may be publicly disclosed to third parties, in particular via the organiser's website and social media channels. In this respect, the data will only be processed with the consent of the winner and thus on the basis of Art. 6 para. 1 sentence 1 lit. a GDPR. After the end of the competition, the data of participants who have not won will be deleted no later than 6 months after the draw. The duration of the storage of the winner's data, which is required for the execution and processing of the contractual relationship, is 3 years after the end of the competition. If the competition is organised via social media channels, the terms of use and data protection notices of the platform providers also apply.
8. disclaimer
Any liability for damages on the part of the organiser in connection with this competition, in particular for damages incurred with regard to the provision and claiming of the prizes, is - to the extent permitted by law - limited to cases of intent and gross negligence. This does not apply in the event of a breach of material contractual obligations, injury to life, limb or health or in the event of mandatory statutory provisions or the assumption of a guarantee. Essential contractual obligations are those whose fulfilment is essential for the proper execution of the competition, whose breach jeopardises the achievement of the purpose of the contract and on whose compliance the participants may regularly rely. In the event of a breach of material contractual obligations, liability is limited to the foreseeable damage typical of the contract.
9. other
Prize claims are not transferable to other persons. Cash payment of the prize value and exchange of the prize are excluded. The law of the Federal Republic of Germany applies to all legal relationships between the parties in connection with the competition, excluding the UN Convention on Contracts for the International Sale of Goods. In the event that participants have their habitual residence in a member state of the EU, German law shall also apply, whereby mandatory statutory provisions of the state in which the participant has his/her habitual residence shall remain unaffected.
Should individual provisions of these conditions of participation be invalid, this shall not affect the remaining provisions. Legal recourse is excluded.
